Sitting in retirement is the policy which currently permits certain judges to retire, draw their pension, and continue to sit as a fee-paid judge, if there is a business need to do so, up to the mandatory retirement age of 75. Judge Kelety fills the vacancy created by the elevation of Justice Patricia Guerrero to the California Supreme Court.
